Landlord Registration
From 30 April 2006, all private landlords will have to be registered with the local authority in which they rent residential property. Online applications can be submitted by logging onto the Landlord Registration (Scotland) website.
Landlord registration is part of the Antisocial Behaviour etc. (Scotland) Act 2004. All private landlords will provide their name, address and contact details and the addresses of their properties for the public register. Although the register is available to the public, the information is limited. There are a number of benefits to registration for both the landlord and the tenant.
The main benefit for landlords is that they will be able to access the services of the Council's Antisocial Behaviour Unit free of charge to assist with antisocial behaviour within private rented tenancies. For further information and guidance contact Environmental Services on 01698 403150.
Smoking Ban
The Smoking Health and Social Care (Scotland) Act 2005 came into effect at 6:00am on Sunday 26th March 2006 and since then it is a criminal offence for a person to smoke in "no smoking premises", as well as an offence for the person having the management or control of premises to allow smoking within them or fail to display no smoking signs on their premises.
No Smoking Premises include premises which are wholly or substantially enclosed and -
- to which the public or a section of the public has access
- which are being used wholly or mainly as a place of work
Premises also includes vehicles and vessels.
The smoking ban covers all local authority premises and vehicles and it is now a criminal offence to smoke in Work Premises or Work Vehicles, with offenders being liable to a fixed penalty fine of £50. It is also a criminal offence for any person, having the management or control of Work Premises or Vehicles to knowingly allow another to smoke within them or fail to display no smoking signs on such premises or vehicles with offenders being liable to a fixed penalty fine of £200.
