Strathclyde Country Park : General Conditions for the Use of All Facilities

1 In all correspondence, posters etc, the venue shall be referred to as Strathclyde Country Park and all correspondence shall be addressed to the Country Parks Manager, Strathclyde Country Park, Watersports Centre, 366 Hamilton Road, Motherwell, ML1 3ED, (Telephone number (01698) 402071 Fax (01698) 252925, who shall fulfil the role of the Council's "Authorised Representative", as referred to herein.

2 All advance applications for block bookings of any of the Park facilities must be made in writing to the Country Parks Manager.

3 Applications to hold organised events must in all cases be made in writing to the Country Parks Manager.

4 Lessees of the Park facilities shall be responsible for maintaining proper order thereon during the period of the Let, and shall be held liable for any loss or damage to property, equipment, furniture and fittings belonging to North Lanarkshire Council, which, in the sole opinion of the Council's authorised representative, is caused by, or arises out of, the Let.

5 Extra fittings or decorations may not be erected within the Park except with the prior approval of the Country Parks Manager and any so approved must be removed immediately after the conclusion of the Let.

6 Any person admitted to Strathclyde Country Park must observe the Management Rules and the conditions of use set out herein. North Lanarkshire Council reserve the right to refuse admission to any person and shall retain full authority to have any undesirable person(s) evicted from the premises, all at the discretion of the Council's authorised representative.

7 The decision of the Country Parks Manager or any of his delegated officers, in respect of admission, allocation, use or closure of facilities is final.

8 No gambling shall be permitted on the premises.

9 The lessee shall at all times adhere to the instructions of the Country Parks Manager or his representative, given for the safeguarding of life and limb, or for the preservation of the property of North Lanarkshire Council, or for any other reason. In particular, the Country Parks Manager may at his discretion, limit the numbers attending in connection with any Let.

10 All fees due must be paid in full before the period of hire commences (see special conditions for pitch hire).

11 North Lanarkshire Council reserves the right to close all, or any part, of the Park, on any occasion, without prior notice.

12 Where a series of weekly, etc lets of Strathclyde Country Park facilities is granted, such lets shall be subject to cancellation without notice, at the discretion of the Country Parks Manager. It will be the responsibility of the Lessees to contact the Council's Booking Office to establish on all occasions that the facility hired is still available on the day of the Let (e.g., inclement weather conditions etc).

13 In the case of cancellation of any booking by the Lessee, the Lessee shall not be entitled to any refund except at the discretion of the Council.

The fee for any let shall in every case be payable in full by any Lessee who cancels as follows:

a) an occasional or block booking of routine facilities on less than 3 days notice;

or

b) a special event or exclusive use of the loch on less than 14 days notice;

or

c) who fails to adhere to a let.

14 In the event of non-payment by any Lessee, the Council will take all necessary steps to recover any monies outstanding.

15 The let is not transferable.

16 North Lanarkshire Council shall not be liable for any loss or damage to goods, property, equipment, clothes or any other articles brought into the premises by the Lessee or any third party.

17 No dogs or other pets shall be allowed in Strathclyde Country Park buildings, except Guide Dogs, Hearing Dogs etc.

18 Anyone storing craft or equipment must provide two identity photographs. All storers should note that they are advised to provide a chain and padlocks to secure their craft to the tie blocks provided to prevent unauthorised removal or wind damage. All loose fittings must be removed from the craft after use. All users are also advised to arrange insurance cover for their craft.

19 It is North Lanarkshire Council's Policy that event sponsorship by prospective lessees is permissible, subject to agreement with the Country Parks Manager or his representative.

20 Lessees may sell programmes to spectators watching an event and keep the entire proceeds subject to agreement in advance with the Country Parks Manager or his representative.

21 Some or all of the above clauses will apply to specific facilities mentioned later herein.

22 From time to time North Lanarkshire Council may retain or grant franchise/s for exclusive rights to persons or organisations to operate within Strathclyde Country Park for the provision of specific services. Such arrangements may affect the organisers of certain events, who are advised to check same with the Country Parks Manager.

23 Floodlight use outwith normal sports bookings will be charged at cost.

24 Charges doubled for Commercial Organisations.

25 North Lanarkshire Council Reserve the right to amend and/or delete any clause of these conditions or any charge for use of the Country Park facilities without prior notice.

Strathclyde Loch - Conditions Of Use

1 No person shall take access to the waters of Strathclyde Loch for whatever purpose without first having obtained authorisation from the Leisure Attendant on duty at the East Wing Boatshed counter or otherwise through the presentation of an appropriate ticket to the funboat attendant.

2 All persons, with the exception of customers using the funboats, shall ensure that they are able to swim a distance of at least 100 metres in a swimming pool or 50 metres in cold water conditions similar to those likely to be encountered on the Loch.

3 All persons shall wear a lifejacket or a buoyancy aid (provided free for funboat customers) when afloat on the Loch. The lifejackets and buoyancy aids shall conform to CE EN 393 50 N and must be worn in accordance with manufacturers' instructions.

N.B. Exception To Condition 3

Proficient rowers in competition or undergoing advanced training, and racing canoeists and senior paddlers needing freedom of movement, will, at their discretion, be allowed on the Loch without lifejackets and/or buoyancy aids. North Lanarkshire Council, however, will accept no liability for any damage to persons or property arising out of this exception.

4 All persons using their own craft on the Loch shall be responsible for checking the conditions and suitability of this craft and other equipment. North Lanarkshire Council reserves the right to restrict the number or category of craft permitted on the Loch at any time.

5 North Lanarkshire Council shall accept liability only for the condition of its own craft and equipment. All persons, clubs or organisations using their own craft or equipment shall be responsible for their own insurance cover of all persons and property involved.

Rescue

6 Rescue craft will be placed on the Loch when considered necessary by the Council's authorised representative in the interests of public safety. In the event of a capsize that cannot be righted, users are instructed to remain with their craft until the rescue boat arrives, when they will be picked up and their craft towed ashore when safe to do so. It is then the responsibility of the users, if able, to stow and return all equipment and the craft to their original locations.

Receipts and Payment

7 All receipts for the use of the Loch and for the hire of various craft will be issued from the Park Booking Office. These receipts must be presented to the Leisure Attendant on duty at the East Wing Boat Shed counter who will issue the appropriate equipment.

Hire

8 North Lanarkshire Council has the following craft available for hire:-

Windsurfers Breakers

Canadian Canoes

9 Water-skiing and Umpire/Teaching Launches may be available for hire on occasions and must be booked in advance.

10 Craft may be hired for the following activities by persons possessing an appropriate certificate of proficiency relevant to the particular sports or any equivalent award approved by North Lanarkshire Council's representatives.

Canoeing - S.C.A. B.C.U. Award

Sailing - S.R.Y.A. R.Y.A. Award

Windsurfing - S.R.Y.A. R.Y.A. Award

Rowing - S.A.R.A. A.R.A. Award

11 In addition to the above awards, introductory courses will be offered by North Lanarkshire Council and the proficiency award granted will be accepted as an indication of competence and will permit the hire of respective craft, subject to appropriate weather conditions.

12 Hirers must be Strathclyde Country Park Proficiency holders or equivalent. If no equivalent is held, it is possible to have a direct assessment of competence (by prior arrangement). In all cases, hirers will be expected to capsize and right respective craft during direct assessment or training courses.

13 Persons having their own craft will pay usage charges only. Persons wishing to hire North Lanarkshire Council craft will pay hire charge plus usage charge.

Exclusive Use Of The Loch

14 The decision to agree to such use will be based on Council Policy, operational circumstances and implications for other users.

15 The charge per day for Exclusive Use of Strathclyde Park Loch will include the loch layout as required for the respective event, one rescue craft and changing facilities. In the event of adverse weather conditions preventing the use of the Loch, hirers will be charged 10% of the Exclusive Use Charge, and all other relevant costs incurred by the Council in preparation for such use.

Additional Craft

16 Craft used over and above one rescue craft, e.g., for umpiring purposes, will be charged at the appropriate rate per hour (See Price List).

Additional Rooms

17 Additional rooms required will be offered at the appropriate rate per hour (See Price List).

18 The foregoing terms deal with the broad outline and Major Event Use. Any variations or additional requirements may be negotiated with the Country Parks Manager.

Angling

19 Angling will be available in Strathclyde Country Park in accordance with the appropriate charge and Conditions of Use.

Requests for other watersports use will be considered on request.

Reservation Of Sports Pitches - Conditions Of Use

1.  All extended let application forms for the regular use of pitches (September-April) must be submitted to arrive not later than 31 July of the current year.

2. Occasional games (one off) may be booked by telephone, letter or personal visit and will be allocated according to availability of pitches (See Payment).

3. Teams are entitled to use the facility booked and authorised and under no circumstances permitted to transfer lets to other clubs or organisations

4. Teams will be held responsible for any damage caused to a facility as a result of misuse or vandalism by their team during their booking. This includes damage to the playing surface caused by unauthorised use.

5. In the event of a pitch being available "same day" lets will be allowed, upon receipt of appropriate payment.

6. School games on Saturdays shall finish by 12 noon to facilitate the readying of pitches for later games.

7. Unless otherwise stated the period allowed for the duration of a game shall be 2 hours from the commencement, after which time the pitch shall be vacated and left free for any other parties desirous of playing.

8. Teams will be allowed entry to dressing rooms ½ hour before commencement of booking time.

Receipts

9. Receipts for various pitches will be issued on payment at the Council's Booking Office. Admission to the respective dressing rooms and pitches will only be allowed on surrender of this receipt to the pavilion leisure attendant.

Payment

10. Payment for an extended let or an occasional booking must be made at the Park's Booking Office. Payment for occasional bookings must be made at least 3 days prior to the match day (ie 12 noon on Wednesday for the following Saturday) after which time in the event of non-payment the pitch may be re-let. Payment for 'same day lets' must be made in person prior to the start time (see "7" above)

Hard Porous Pitches

11 In addition to being offered for regular matches as under the above conditions, the Hard Porous Pitches will also be available for hire for the purposes of hourly sessions.

 

Please Note Studded footwear is not permitted on Hard Porous Pitches and the lessee is responsible for ensuring that both his own team and their opponents wear training shoes only.

Charges doubled for Professional Clubs, etc. for the above facilities.

Strathclyde Country Park

Caravan and Camping Site Conditions Of Use

General

1 (a) These conditions of use are additional to the obligation on all persons to observe Management Rules and the Country Code.

(b) The use of the word "caravan" includes motor caravans.

(c) The site shall be open only to touring caravans/tents of recognised manufacture and good construction.

Admittance To The Site

2 (a) No caravan/tent which bears any advertising matter other than normal manufacturers' transfers or plates will be admitted to the site.

(b) On arrival, report to the representative of the Country Parks Manager (warden at the site Reception) for pitch instructions, and enter name and address in the site register.

(c) Caravans towed by lorries, commercial vehicles, closed highsided vans, and vehicles over 1 tonne axle weight are not permitted on the site.

(d) Maximum length of Caravan allowed on site is 7 metres.

Use Of Caravan/Tent

3 (a)` No caravan/tent may be used by more than the number of persons it is designed for. The Country Parks Manager or his representative shall be the sole judge of what is a reasonable occupancy number for each caravan/tent.

(b) Sub-letting of the caravan or of the pitch is forbidden.

Awnings and Tents

4 A visitor may erect a lean-to or awning, provided it forms part of the caravan and can be readily dismantled and transported with it. Toilet tents, designed as such are also permitted. Other tents may be erected provided that they are intended only as additional sleeping accommodation and that permission has first been obtained from the Country Parks Manager or his representative. To minimise damage to grass, the Country Parks Manager or his representative is empowered to require visitors to periodically lift groundsheets and/or side flaps of awnings or tents.

The Pitch

5 (a) Caravans must be pitched in positions indicated by the Country Parks Manager or his representative and in any case so as to allow not less than 6.5 metres minimum spacing between facing walls of adjacent tents or caravans. They must be moved to fresh pitches at the request of the Country Parks Manager or his representative at any time when this seems necessary to him to maintain the ground in good condition.

(b) The pitch must be kept clear of spare equipment and nothing (other than waste water,/fresh water receptacles or gas cylinders) may be stored under or outside the caravan or tent. On taking the unit off the pitch, the latter must be left clean and tidy.

(c) No caravan/tent may be left unoccupied overnight or for more than 18 hours without the permission of the Country Parks Manager or his representative.

Sanitation

6 (a) Properly constructed toilet tents may be erected on site in positions indicated by the Country Parks Manager or his representative.

(b) The contents of chemical closets must not be disposed of except by emptying at the disposal points provided or in accordance with the instructions of the Country Parks Manager or his representative.

(c) To avoid possible damage to sewage purification works, visitors may use only formaldeyde-based chemical fluids. Under no circumstances may coaltar phenol or caustic-based fluids be used.

Waste Water

7 A bucket or other suitable receptacle, which must not be allowed to overflow, must be used for the collection of sink waste water and emptied at the disposal points provided.

Disposal Of Rubbish

8 All waste paper and other solid refuse must be deposited in the receptacles provided for the purpose. Tea leaves must be well wrapped and disposed of similarly.

Surface of Site

9 (a) Holes must not be dug in the turf.

(b) All vehicles must be driven on the roadway or tracks, and care must always be taken to minimise danger to the surface of the site during wet weather.

Fires

10 Fires must not be lit on the site. Occupants must acquaint themselves with the safety procedures against fire and the whereabouts of the fire-points.

Dogs and Other Pets

11 (a) All dogs and other pets must be kept under control. No animal may be allowed loose on the site and leads must not exceed 10 feet.

(b) The Country Parks Manager or his representative is empowered to require any visitor to leave the site whose pet in his opinion becomes a nuisance

Noise

12 Musical instruments, audio systems, T.V.'s and radios must not be used to the inconvenience of other people on the site. Electric generators, must not be used between 6.00pm and 8.00am.

Speed Limit

13 The speed of vehicles on site must not exceed 15m.p.h. Only a person in possession of a current full driving licence may drive on the site.

Trading

14 Trading, including the buying and selling of caravans/tents will not be allowed on the site, except where franchised and authorised by North Lanarkshire Council.

Advance Booking Of Pitches

15 When pitches are booked in advance, a non-returnable deposit of one night's site fee must accompany the application for each pitch. Where the booking is not taken up, the deposit will not be returned nor will the pitch be kept vacant after 12 noon the following day. It is of assistance if particulars of outfit and number of occupants are given when making advance bookings.

Site Fees

16 Site fees are inclusive of complete outfit and are payable on arrival.

Additional parking requirements will be at the discretion of the Country Parks Manager or his representative, having regard to circumstances.

Vacation Of Pitches

17 All pitches must be vacated by 12 noon on the day of departure.

Management

18 (a) Authority for the conduct of the site is vested in the Country Parks Manager or his representative for the time being.

(b) Accommodation is provided on the condition that all rules, notices displayed on the site, and instructions of the Country Parks Manager or his representative, are strictly observed and that all persons conduct themselves at all times with due regard for others.

(c) Any person in breach of these rules may be asked to leave the site by the Country Parks Manager or his representative. The refund of the appropriate portion of any site fees paid in advance shall be a sufficient discharge of all obligations to any person who is required to leave because of any breach of these rules.

(d) North Lanarkshire Council will not accept any liability for any loss or damage to property howsoever caused.

(e) Applicants are reminded that postal bookings should include a self addressed envelope.

Total Duration on Site

19 No person shall be permitted to reside within the Caravan/Camping Site for more than 14 consecutive nights.

 

Follow The Country Code

Guard against all risks of fire - Plantations, woodlands and heaths are highly inflammable; every year acres burn because of casually dropped matches, cigarette ends or pipe ash.

Fasten all gates - Even if you found them open. Animals can not be told to stay where they are put. A gate left open invites them to wander, a danger to themselves, to crops and to traffic.

Keep dogs under proper control - Farmers have good reason to regard visiting dogs as pests. In the country a civilised town dog can become a savage. Keep your dog on a lead wherever there is livestock about, also on country roads.

Keep to the paths across farm land - Crops can be ruined by people's feet. Remember that grass is a valuable crop too, sometimes the only one on the farm. Flattened corn or hay is very difficult to harvest.

Avoid damaging fences, hedges and walls - They are expensive items in the farm's economy; repairs are costly and use scarce labour. Keep to recognised routes using gates and stiles.

Leave no litter - All litter is unsightly, and some is dangerous as well. Take litter home for disposal; in the country it costs a lot to collect it.

Safeguard Water Supplies - Your chosen walk may well cross a catchment area for the water supply of millions. Avoid polluting it in any way. Never interfere with cattle troughs.

Protect wild life, wild plants and trees - Wild life is best observed, not collected. To pick or uproot flowers, carve trees and rocks, or disturb wild animals and birds destroys other people's pleasure as well.

Go carefully on country roads - Country roads have special dangers, blind corners, high banks and hedges, slow-moving tractors and farm machinery or animals. Motorists should reduce their speed and take extra care; walkers should keep to the right, facing oncoming traffic.

Respect the life of the countryside - Set a good example and try to fit in with the life and work of the countryside. This way good relations are preserved and those who follow are not regarded as enemies.
