North Lanarkshire Council (hereinafter referred to as 'the Council') by virtue of the powers conferred on them by Section 112 of the Civic Government (Scotland) Act 1982 hereby make the following Management Rules to regulate the use of and conduct of persons while in the Council's Community Services facilities, premises or land, owned or occupied or managed by the Council or otherwise under their control to which the public have access whether on payment or otherwise. The Supplementary Management Rules for Public Libraries, Public Parks, Country Parks and Burial Grounds, Public Sports Facilities, Museums and Heritage Sites, Civic Amenity Sites, Landfill Sites and Cleansing Depots, should be read in conjunction with these Management Rules.
Interpretation
The provisions of the Interpretation Act 1978 shall apply to the interpretation of these Management Rules as they apply to the interpretations of an Act of Parliament.

'Director' means the Director of Community Services (or the officer holding any position of a similar nature) of the Council for the time being or any duly designated officer of the Council staff representing him/her or acting on his/her behalf |

'Facility' means and includes any: |
| |
Park any land for the purpose of recreation games, sports or amusements or as a public playground, public open space, public walkway, nursery, ornamental or pleasure ground, public place or resort or recreation or public garden or Local Nature Reserve or Burial Ground and includes any buildings situated thereon, owned by, leased by, occupied by or under the control of the Council situated within North Lanarkshire. |

Sports Facility sports centre, sports hall, leisure centre, swimming pool or other similar premises or facility |
| |
Library every public library including mobile library |
| |
Community Facility every Community Centre, Community Education Centre, School, Area Office, Senior Citizen Centre, OAP Hut or similar premises owned by or leased from the Council |
| |
Venues & Community Arts Facilities concert hall, theatre or community arts facility used for performances, events or participatory arts activities |
| |
Museums every museum and heritage facility |
| |
Cleansing Services all civic amenity sites, cleansing depots and landfill sites |
| |
Careers Service career advice and guidance offices operating in North Lanarkshire |
| |
Transport Services all MOT testing bays, tail-lift testing sites and taxi conformance testing areas |
| |
Public Toilets all public conveniences, supervised and unsupervised. |
| |
Office/Reception Areas areas where members of the public are received and/or reservations made. |
| |
The above includes all landscaped areas, footways or car parks and other land associated with or used in conjunction with any other facility as defined in these Management Rules. |

1. |
Nothing in these Management Rules shall interfere with or prevent the execution of any duties of the Director and any act of the Director necessary for the proper performance of his/her duties shall not be deemed or considered to be in contravention of these Management Rules. |
|
2. |
No person shall enter or leave any facility except by way of the duly appointed entrance or exits. |
|
3. |
No person shall enter an "Unauthorised Area" except with the prior consent of the Director. |
|
4. |
No person shall enter or wilfully remain within any facility when such facility is closed to the public. |
|
5. |
No person shall enter or use a changing room, locker or shower in a facility except for that specific purpose and no persons shall loiter in or at any passageway, access point, entrance, exit or changing room in a facility. |
|
6. |
No person shall, except with the permission of the Director, remain in or use a facility when asked to leave by the Director, whether in the event of an emergency or otherwise. |
|
7. |
Except where the supplementary management rules provides to the contrary, no person under the age of sixteen years of age shall be permitted or allowed to enter, remain in or use a facility (or any part thereof) unsupervised except for the purpose of engaging in an official and authorised event or activity. |
|
8. |
The Director reserves the right to refuse entry to any person entering a facility. |
|
9. |
No person shall be permitted to use any facility without prior payment of the appropriate charge or ticket where applicable. Any special discount card (including Passport to Leisure) shall be produced and exhibited before entry and no person shall supply false particulars for the purposes of obtaining any such discount cards. |
|
10. |
No person shall, except with the permission of the Director, engage in any event or activity in a facility unless wearing or using the equipment and clothing appropriate to that event or activity. |
|
11. |
All gangways, doorways, stairways, entrances, exits and emergency exits shall be kept clear and unobstructed at all times. |
|
12. |
No person under the age of 16 years of age will be admitted to any event/production that the Director deems to be unsuitable in any way. |
|
13. |
The Director reserves the right to refuse entry to any person whom he/she considers does not meet the minimum age requirement of a film's legal certification showing at any facility or in any licensed premises in a facility. |
|
14. |
No part of a facility shall, except with the consent of the Director, be used by any persons other than for the purpose which it is specifically designed or adapted for use. No equipment, furniture, fittings or other contents of a facility shall be used otherwise than in accordance with the instruction of the Director and no person shall cause or permit any unauthorised use of any equipment, furniture, fittings or other contents. |

15. |
No person, without the consent of the Director, shall deposit or leave or cause to suffer or fall or to be deposited or left in any facility:
- any substance or article likely to cause injury or damage to any person or property, or
- Any substance or article which might occasion risk of any kind to any child or other person finding or handling same, or
- Any waste or other harmful matter

16. |
No person shall throw down, deposit or leave any rubbish, refuse, litter or paper of whatever description in any facility, other than that in a receptacle/location provided for that purpose. |
|
17. |
No person shall bring into a facility any article or thing which, in the opinion of the Director, would be likely to cause injury to any person or damage to a facility or any part thereof of the equipment, furniture, fittings or other contents. |
|
18. |
No person shall wilfully, carelessly or negligently damage, injure, displace or remove any part of a facility including a building, wall, fence, barrier, railing or any other fixture situated in or on or adjacent and ancillary to a facility, or deface or destroy the same by cutting, writing or otherwise. Any person so doing will be held responsible for the cost of any replacement or repair. |

19. |
No person shall wilfully, carelessly soil, tear, cut, deface, damage, injure or destroy any item or contents of a facility. Any person so doing will be held responsible for the cost of any replacement or repair. |
|
20. |
No person who is offensively unclean in person or dress or who is suffering from an infectious disease or whose appearance or state, in the opinion of the Director, is unsuitable or undesirable shall be permitted or allowed to enter or use a Council facility. |
|
21. |
Any person who is either in a state of intoxication or under the influence of drugs in the opinion of the Director shall not enter or be allowed to remain on a facility and shall remove themselves upon being requested to do so. |
|
22. |
No person shall consume any spirituous or intoxicating liquor in a facility except in specified licensed areas. |
|
23. |
No person shall take, sell or distribute drugs in any facility or any part thereof except in a case requiring first aid treatment where the administering of drugs is necessary and performed by an appropriately qualified medical practitioner or where the drugs are taken as part of a prescribed course of medication. |
|
24. |
No person shall tamper with or damage any fire alarms, smoke detectors or fire fighting equipment located in any facility. |
|
25. |
The production, consumption or sale of food and drink in facilities by users/hirers of a facility where there already exists a council retail food/drink outlet, is not permitted, except with the consent of the Director. |
|
26. |
Where no council retail food/drink outlet is in existence in a facility, no person shall bring in or partake of any form of refreshment or food except in designated refreshment areas or those areas allowed by the Director, and all appropriate food and drink regulations should be adhered to. |
|
27. |
No person shall smoke in any part of a facility except in designated 'Smoking Areas'. |
|
28. |
No person shall, except with the consent of the Director, display, affix or post any bill, placard or notice upon any part of a facility or distribute any bill or other written or printed paper in a facility. |
|
29. |
No person shall, except with the prior consent of the Director, sound or play any musical instrument, sing or perform or operate any radio or television receiver, record player, tape recorder or other sound producing device in any part of a facility set apart for the use of the public. |
|
30. |
No person shall, except with the express written consent of the Director, and being in possession of the relevant license, be permitted to gamble in any part of a facility. |
|
31. |
No person shall, except with the express verbal and/or written consent of the Director, and subject to any rules of copyright which may exist, take any photographs or films, or make any recording by any means whatever of any event or activity taking place in a facility. |
|
32. |
No person shall, except with the express written and/or verbal consent of the Director, and being in possession of the relevant license, be permitted to sell and/or market goods/items nor engage in any trade or business of any kind in any part of a facility. |
|
33. |
No person shall cause or permit a dog or other animal belonging to them or otherwise under their control to enter or remain in a facility unless the dog is a working dog in use by a registered blind or deaf person or as part of a specific let authorised by the Director, except where the supplementary rules provide to the contrary. |
|
34. |
No person shall behave in a disorderly or offensive manner in a facility, or use violent, abusive or obscene language therein, or prevent the proper use or regulation of a facility. |
|
35. |
No person shall, except with the express written consent of the Director, engage in and/or organise a public meeting/assembly in any part of a facility. |
|
36. |
The Director cannot accept responsibility for any person who has been injured within a facility whilst engaged in unauthorised activities, or activities that contravene any of the aforementioned rules. |
|
37. |
No person shall wilfully obstruct, disturb, interrupt or annoy any other person in their proper or authorised use of a facility, or wilfully obstruct, disturb or interrupt the Director in the performance of his/her duties. |
|
38. |
Every person shall observe any reasonable and lawful instruction that may be given by the Director. |
|
39. |
Any person who |

- on being required to leave any land or facility by the Director who has reasonable grounds for believing that the person has contravened, is contravening or is about to contravene any management rule applying to the land or premises, fails to leave; or
- on being informed by the Director who has reasonable grounds for believing that the person is about to contravene any management rule applying to any land or premises that they are excluded from the land or premises, enters or attempts to enter the land or premises; or
- being a person subject to an exclusion order under Section 117 of the Civic Government (Scotland) Act 1982, enters or attempts to enter the land or premises to which the exclusion order relates
shall be guilty of an offence and liable, on summary conviction of a fine not exceeding level 1 on the standard scale. |

40. |
The Council shall be at liberty to revise, alter or dispense with any or all of these Management Rules when they see cause, and to enact others in their place. |

SUPPLEMENTARY MANAGEMENT RULES FOR PUBLIC LIBRARIES
North Lanarkshire Council (hereinafter referred to as 'the Council') by virtue of the powers conferred on them by Section 112 of the Civic Government (Scotland) Act 1982 hereby make the following Supplementary Management Rules to regulate the use of and conduct of persons while in North Lanarkshire Council's Public Libraries. These Supplementary Management Rules should be read in conjunction with the Management Rules for the Department of Community Services.

No person shall remove an item from the Information Service Section without the permission of the Director. A person entering such Section shall be responsible for any item consulted by them for any loss or damage thereto. |

2. |
A person shall not make a tracing of any portion of an item without the permission of the Director. |
SUPPLEMENTARY MANAGEMENT RULES FOR PUBLIC SPORTS FACILITIES
North Lanarkshire Council (hereinafter referred to as 'the Council') by virtue of the powers conferred on them by Section 112 of the Civic Government (Scotland) Act 1982 hereby make the following Supplementary Management Rules to regulate the use of and conduct of persons while in North Lanarkshire Council's Public Sports Facilities. These Supplementary Management Rules should be read in conjunction with the Management Rules for the Department of Community Services.

No person shall, except with the consent of the Director, bring into a sports facility any bottle or similar container made of glass or other breakable material unless properly and adequately protected from the risk of breakage. |
|
2. |
No child under the age of eight years of age shall be permitted or allowed to enter, remain in or use a sports facility or any part thereof unless accompanied by and in the charge of a responsible adult person |
|
3. |
No person under the age of sixteen years of age shall be permitted or allowed to enter, remain in or use a conditioning room/weights room or any item of equipment therein, unless being specifically instructed by an appropriately qualified or suitably competent person. |
SUPPLEMENTARY MANAGEMENT RULES FOR PUBLIC PARKS
North Lanarkshire Council (hereinafter referred to as 'the Council') by virtue of the powers conferred on them by Section 112 of the Civic Government (Scotland) Act 1982 hereby make the following Supplementary Management Rules to regulate the use of and conduct of persons while in North Lanarkshire Council's Public Parks. These Supplementary Management Rules should be read in conjunction with the Management Rules for the Department of Community Services.

Except with the express written consent of the Director, no person shall pluck, cut, destroy, remove or injure any flower, flower bed, soil, floral container, grass, tree, shrub or plant in a park. |
|
2. |
No person shall enter or stand, sit or walk in or upon any flower bed, border or shrubbery within any park or in or upon any part of any park where prohibitive notices are displayed. |
|
3. |
Except with the written consent of the Director, no person shall engage in any operation on, or connected with, hunting, shooting, snaring, trapping, taking or destroying animals or birds and without prejudice to the public use of existing Rights of Way, no person shall bring or have any engine, instrument or apparatus used or capable of being used for hunting, shooting, fishing, taking or destroying of animals or birds within any park. |

4. |
Except with the written consent of the Director, no person shall wilfully kill, take, annoy/worry or disturb any animal or bird or take or injure the nest, eggs or young of any animals or birds within a park. |
|
5. |
No person shall, except with the prior written consent of the Director, carry or discharge any firearm, airgun or firework in a park, and no person shall throw or release any stone or other missile in the park. |
|
6. |
No vehicle, whether mechanically propelled or otherwise, shall be permitted or allowed to enter a park without the prior written consent of the Director, except by way of recognised and approved access route. |
|
7. |
No person shall drive a vehicle, whether mechanically propelled or otherwise, in a park except for the purpose of passing through the same by way of a recognised and approved driveway therein, and then only at a speed not exceeding any displayed restrictions and no person shall ride a bicycle in a park or any part thereof at such speed or at such a place or in such a manner so as to disturb, obstruct, interrupt or annoy any other person in their proper or authorised use of a park. |

The provisions contained in Supplementary Management Rules numbers 6 and 7 shall not apply to the use in any park of any perambulator or similar vehicle drawn or propelled by hand for the use by a child or invalid or of any ambulance, fire engine, police vehicle, hearse and attendant vehicles as may be permitted by the Director. |

9. |
No person shall cause or permit a dog or any other animal belonging to them or otherwise under their control to enter or remain in a park unless such a dog or other animal is under the full control of that person and effectively restrained from causing annoyance to any person, or from worrying or disturbing any wild birds or animals or from damaging any flower, plant, tree or shrub in a park. |

10. |
No person shall cause or permit a horse belonging to them or otherwise under their control to enter or remain in a park unless on a designated bridleway or in such an area as set aside by the Director. |
|
11. |
Under Section 48 of the Civic Government (Scotland) Act 1982 and the Environmental Protection Act 1990 Part IV (as amended by the Litter (Animal Droppings) Order 1991 or any future legislation of a similar nature) no person shall cause or permit any dog or other animal belonging to them or otherwise under their control to foul in a park or any part thereof except in such area or areas as may from time to time be approved and designated by the Council for use as such and bearing an appropriate intimation. |

12. |
No person shall wade, wash, bathe or fish in any pond, pool, fountain or water in a park, or make use of any water-borne craft therein, except those as may be authorised and approved by the Director under such conditions and at such times as may from time to time be prescribed and authorised by the Director, and no person shall throw or put sticks, stones or substances of any description in any pond, pool, fountain or water in a park or pollute any such pond, pool, water or any water course in a park. |

No person shall play cricket, football, rugby, hockey or similar sport in any park except during such period or periods and at such suitable places as may be determined by the Director.
No person shall play or practice golf in any park except in such areas designated by the Director. |

No person shall light a fire, burn or do any action which might cause to be set on fire or burned in a park any paper, rubbish, refuse, fuel or other substance, except with the prior consent of the Director. |
|
15. |
No person shall, without prior written consent of the Director, erect, occupy or use any tent or other structure in a park, except within a designated camping area. |

SUPPLEMENTARY MANAGEMENT RULES FOR BURIAL GROUNDS
North Lanarkshire Council (hereinafter referred to as 'the Council') by virtue of the powers conferred on them by Section 112 of the Civic Government (Scotland) Act 1982 hereby make the following Supplementary Management Rules to regulate the use of and conduct of persons while in North Lanarkshire Council's Burial Grounds. These Supplementary Management Rules should be read in conjunction with the Management Rules for the Department of Community Services.

No dressing of stones or work of any kind may be carried out by or on behalf of any lair holder which the Director deems objectionable and therefore no such work shall be permitted within any burial ground until the written permission of the Director has been obtained, and all rubbish whatever in connection with such work shall be removed without delay, failing which the Director shall have the same carried out at the expense of the lair holder, and the Council shall be entitled to recover the said expense from the lair holder. |

2. |
No dressing of lairs shall be carried out, nor shall agreements be entered into for such upkeep of lairs. |
|
3. |
All visitors to burial ground situated within North Lanarkshire shall require to keep on the paths and roads, and except when tending a grave shall be strictly prohibited from touching monuments, plants or flowers. Children under the age of thirteen years shall not be admitted unless accompanied by a responsible adult. No dogs except on a leash are permitted in any burial ground. |

No ball games of any description are permitted within any burial ground operated by the Council. |
|
5. |
All vehicles entering a cemetery must be driven carefully and slowly and keep to the roadways. |
|
6. |
The Council shall have the entire and exclusive right to close to the public at any time all or any part of any burial ground, if considered necessary, and without giving notice of their intention to do so. |
|
7. |
The Director shall be entitled at any time to have removed any person or persons who may conduct themselves improperly; he/she shall also be entitled to prevent persons from entering during prohibited hours. No person shall be allowed within any burial ground after the hours fixed for admission of visitors. |
|
8. |
No shrubs or flowers shall be planted in any lair except with the prior written approval of the Director and at the expense of the lair holder. The Director shall be entitled to have plants and shrubs pruned and if necessary removed if, in his/her opinion, they have become too large, or, by spreading of their roots or branches, injury may be done to the ground, monuments, walks or roads. |

Cycling is strictly prohibited within any burial ground. Any person or persons contravening the foregoing shall be liable to the Council for any and all damage, injury or the like, which is occasioned thereby. |
SUPPLEMENTARY MANAGEMENT RULES FOR COUNTRY PARKS
North Lanarkshire Council (hereinafter referred to as 'the Council') by virtue of the powers conferred on them by Section 112 of the Civic Government (Scotland) Act 1982 hereby make the following Supplementary Management Rules to regulate the use of and conduct of persons while in North Lanarkshire Council's Country Parks. These Supplementary Management Rules should be read in conjunction with the Management Rules for the Department of Community Services.
Interpretation
The provisions of the Interpretation Act 1978 shall apply to the interpretation of these Supplementary Management Rules for Country Parks as they apply to the interpretation of an Act of Parliament.
'Notice' a Notice issued by or with authority of the Council and posted on, at or near the place to which it refers.
'Water Fittings' includes pipes (other than mains), taps, cocks, valves, ferrules, meters, cisterns, baths, sinks, water closets, soil pans and other similar apparatus used in connection with the supply and use of water.
'Waterworks' includes springs, wells, pumps, reservoirs, cisterns, tanks, aqueducts, cuts, sluices, mains, pipes, culverts, engines and all machinery, lands, buildings and things for the supply of water or used for protecting sources of water supply or for other public purposes.
'Water Course' includes all rivers, streams, lochs, ditches, drains, cuts, culverts, dykes, sluices and passages through which water flows.

No vehicle, whether mechanically propelled or otherwise, shall be permitted or allowed to enter a Country Park without the prior written consent of the Director, except by way of recognised and approved access route. |

6. |
No person shall drive a vehicle, whether mechanically propelled or otherwise, in a Country Park except for the purpose of passing through the same by way of a recognised and approved driveway therein, and then only at a speed not exceeding the restrictions imposed and no person shall ride a bicycle in a Country Park or any part thereof at such speed or at such a place or in such a manner so as to disturb, obstruct, interrupt or annoy any other person in their proper or authorised use of a Country Park. |

The provisions contained in Supplementary Management Rules numbers 5 and 6 shall not apply to the use in any Country Park of any perambulator or similar vehicle drawn or propelled by hand for the use by a child or invalid or of any ambulance, fire engine, police vehicle, hearse and attendant vehicles as may be permitted by the Director. |

No person shall cause or permit a dog or any other animal belonging to them or otherwise under their control to enter or remain in a Country Park unless such a dog or other animal is under the full control of that person and effectively restrained from causing annoyance to any person, or from worrying or disturbing any wild birds or animals or damaging any flower, plant, tree or shrub in a Country Park. |

9. |
No person shall wilfully kill, take, annoy/worry or disturb any animal or bird or take or injure the nest, eggs or young of any animals or birds within a Country Park, except with the written consent of the Director. |
|
10. |
No person shall engage in any operation on, or connected with, hunting, shooting, snaring, trapping, taking or destroying animals or birds and without prejudice to the public use of existing Rights of Way, no person shall bring or have any engine, instrument or apparatus used or capable of being used for hunting, shooting, fishing, taking or destroying of animals or birds within any Country Park, except with the written consent of the Director. |

11. |
No person shall enter, foul or pollute any river, stream, loch, pond or other water upon or bounding a Country Park. |
|
12. |
No person shall wilfully or negligently break or otherwise damage any ice in any water (other than water provided by the Council for the purpose of bathing, wading or washing) or throw, place or deposit in any water, any stick or any substance of any description. |
|
13. |
No person shall wilfully or negligently disturb, annoy or injure any animals grazing in a Country Park. |
|
14. |
No person shall cause or suffer any dog belonging to them or otherwise under their control, within a Country Park, to enter any building, shelter, children's playground, nature reserve area, nursery, competition area or arena, ornamental or other water or any place from which the Director by Notice conspicuously displayed has specifically excluded dogs. Dogs are not permitted within the animal area of Palacerigg Country Park |

15. |
No person shall race or train any dog in a Country Park. |
|
16. |
No person shall, without prior specific permission of the Director bring or cause to be brought into a Country Park any cattle, sheep or pigs, or any beast of draught or burden or any poultry. |
|
17. |
No person shall, without prior specific permission of the Director lead, ride, drive, exercise, train or exhibit any horse or other animal. |
|
18. |
No person shall, without prior specific permission of the Director wilfully bring or permit to be brought into a Country Park any living creature or the egg of any living creature or any plant or any seed or any other part of any plant in such circumstances that is likely that such a creature or plant will reproduce or propagate itself or that such egg will hatch or that such seed will germinate. |

19. |
No person shall damage or obstruct the flow of any drain or watercourse, or open, shut or otherwise interfere with any sluice-gate or other apparatus upon a Country Park, except with prior consent of the Director. |
|
20. |
No person shall wilfully or negligently injure, suffer to be injured or in any way interfere with any Waterworks or Water Fittings. |
|
21. |
No person shall damage a Country Park, any part thereof or anything thereon or therein, including, without prejudice to said generality, any tree, bush, shrub, plant, hedge, fence, wall or gate. |
|
22. |
No person who opens or unfastens a gate upon a Country Park shall fail to ensure that such gate is shut or fastened before leaving it. |
|
23. |
No person shall affix or cause to be affixed any advertisement, bill, placard, notice, picture or writing, upon any building, wall, fence, gate, door, pillar, post, tree, rock or stone, in, upon or abutting on a Country Park nor shall any person deface by cutting, painting or otherwise writing or making words or remarks on any such building, wall, fence, gate, door, pillar, post, tree, rock or stone. |

24. |
No person shall wilfully, carelessly or negligently throw, roll or discharge any stone or other missile upon a Country Park so as to cause, or to be likely to cause, injury, danger or annoyance to any person or injury, danger or molestation to any animal or bird. |
|
25. |
No person shall throw, deposit, cause or suffer to fall, to be thrown, or deposited any paper, bottle, glass, rubbish, refuse or filth in a Country Park, except in receptacles specifically provided for that purpose |

26. |
No person shall, without prior written consent of the Director, erect, occupy or use any tent or other structure in a Country Park. |
|
27. |
No person shall either bring onto a Country Park any caravan for the purpose of residing there overnight or occupy or use any caravan on a Country Park for such purpose, except in such areas designated by the Director. |
|
28. |
No person shall wilfully obstruct, disturb, interrupt or annoy any other person in the proper use of a Country Park or wilfully obstruct, disturb, or interrupt any Officer of the Council in the proper execution of any work in connection with the laying out or maintenance of a Country Park. |

No person shall enter or leave a Country Park other than by way of a recognised road or footpath, signposted as such. |
|
30. |
No person shall drive a motor vehicle within a Country Park unless that person holds and is entitled to hold a licence to drive such a vehicle. No motor vehicle shall be driven within a Country Park by a person who is authorised to drive by virtue only of being the holder of a provisional licence. |
|
31. |
No person shall, without the prior specific permission of the Director, hold or cause to be held, site or cause to be sited within a Country Park any Fair or mechanical amusement, or play on or make or cause to be made any sound with any musical instrument or give or take part in any performance of exhibition of music or of other sound. |
|
32. |
No person shall, within a Country Park, fly or permit to be flown any model aircraft nor sail or permit to be sailed any model yacht, ship or boat except on such part of a Country Park or the waters thereof as the Director may by Notice or otherwise set apart for the purpose of the flying or sailing of such models and no person shall wilfully interfere with or obstruct the flying or sailing of any such model belonging to another person. |

33. |
No person shall use any swing or gymnastic or playing appliance in contravention of any Notice set up in a conspicuous place or places near thereto indicating the age or gender of the person by whom the swing or gymnastic appliance may be used. |
|
34. |
No person shall enter, occupy or otherwise use any building, shelter, seating accommodation or other area, the use whereof has, by Notice conspicuously displayed, been restricted to persons above or within certain age groups or of one particular gender. |
|
35. |
No person shall, without the prior specific consent of the Director, enter into or upon a Nature Reserve area. |
|
36. |
The Director may by Notice, and without the necessity of prior warning, close a Country Park or any part thereof at any time and for such periods as they may deem necessary or expedient. |
|
37. |
Nothing in the provisions of these supplementary management rules shall entitle a person to enter or be on a Country Park, or to do anything thereon, in contravention of any prohibition contained in or having effect under any enactment. |
SUPPLEMENTARY MANAGEMENT RULES FOR MUSEUMS AND HERITAGE SITES
North Lanarkshire Council (hereinafter referred to as 'the Council') by virtue of the powers conferred on them by Section 112 of the Civic Government (Scotland) Act 1982 hereby make the following Supplementary Management Rules to regulate the use of and conduct of persons while in North Lanarkshire Council's Museums and Heritage Sites. These Supplementary Management Rules should be read in conjunction with the Management Rules for the Department of Community Services.

No person shall remove any item from the local studies or archives sections without the permission of the Director. A person entering into these sections shall be responsible for any item consulted by them for any loss or damage thereto . |

2. |
No person shall remove any item from the museum collections without permission of the Director. A person borrowing any item from the museum collections for any purpose shall be responsible for any loss or damage to that item. |
|
3. |
No person shall damage any item on display, including without generality, any machine, locomotive, tramcar, display panel, work of art or other item from the museum collections. |
|
4. |
No person shall obstruct or in any way interfere with the tram way track, passage of the tramcar or overhead power lines at Summerlee Heritage Park. |
|
5. |
No vehicle, whether mechanically propelled or otherwise shall be permitted to enter the museum grounds without the prior consent of the Director except by way of a recognised and approved access route. |
|
6. |
No person shall drive a vehicle, whether mechanically propelled or otherwise, in the museum grounds except for the purpose of passing through the same by way of a recognised and approved driveway and with regard to any speed restrictions imposed. |
|
7. |
The provisions contained in numbers 5 and 6 shall not apply to the use of any perambulator or similar vehicle drawn or propelled by hand for the use by a child or invalid or of any ambulance, fire engine, police vehicle, as may be permitted by the Director. |
|
8. |
No person shall drive a motor vehicle within the museum grounds unless they hold a licence to drive such a vehicle. |
|
9. |
Cycling is strictly prohibited within the museum sites. Any person contravening the foregoing shall be liable to the council for any and all damage or injury which is occasioned thereby. |
|
10. |
No unaccompanied children aged 14 years and under are permitted to enter Summerlee Heritage Park. |
|
11. |
No person shall cause or permit a dog or any other animal to enter the museum site with the exception of guide dogs for the visually impaired and hearing dogs. |
|
12. |
Except with the permission of the Director, no person shall pluck, cut, destroy, remove or injure any flower, flowerbed, soil, floral container, grass, tree, shrub or plant in the museum grounds. |
|
13. |
No person shall engage in any operation on or connected with hunting, shooting, trapping, taking or destroying birds in the museum grounds. |
|
14. |
No person shall wilfully kill, take, annoy or disturb any animal or bird or injure the nest, eggs or young of any animal or bird within the museum grounds. |
|
15. |
No person shall be permitted to wash, bathe, swim or fish in the canal or any fountain within the museum grounds, or make use of any water-borne craft therein except those approved and authorised by the Director. |
|
16. |
No person shall throw or put sticks, stones or substances of any description into any canal or fountain or pollute these in any way. |
|
17. |
No person shall damage or obstruct the flow of any drain or watercourse or interfere with any sluice gate associated with any canal within the museum grounds. |
|
18. |
No person shall play or practice golf in the museum grounds. |
|
19. |
No person shall light a fire, burn or carry out any action which might cause to be set on fire any paper, rubbish, refuse, fuel or other substance in the museum grounds except with prior permission of the Director. |
|
20. |
No person shall erect or occupy a tent or any other structure in the museum grounds. |
|
21. |
No person shall hold or cause to be held any fair or mechanical amusement except with prior permission of the Director. |
SUPPLEMENTARY MANAGEMENT RULES FOR CIVIC AMENITY SITES
North Lanarkshire Council (hereinafter referred to as 'the Council') by virtue of the powers conferred on them by Section 112 of the Civic Government (Scotland) Act 1982 hereby make the following Supplementary Management Rules to regulate the use of and conduct of persons while in North Lanarkshire Council's Civic Amenity Sites. These Supplementary Management Rules should be read in conjunction with the Management Rules for the Department of Community Services.

All persons using or servicing the Civic Amenity Site shall have regard to the fact that the site is governed by a Waste Management Licence issued by the Scottish Environment Protection Agency and shall therefore ensure that the site is operated within the requirements of the Working Plan dictated by this licence. Copies of the Working Plan are available on site. |
|
2. |
All persons using or servicing the site shall obey the instruction or advice of the attendant at all times. Persons who fail to adhere to attendant's instructions will be required to leave the site |
|
3. |
No persons under the age of 16 years will be permitted on site except where suitably supervised by an adult. |
|
4. |
All persons using or servicing the site shall have regard to traffic management on site and in particular obey any instructions of the attendant. |
|
5. |
All persons shall obey the instructions of the attendant in cases where the site is fully loaded or where temporary closure is required to service banks or containers even when no prior notice is given of the same. |
|
6. |
Trade Waste is not permitted at the sites and persons utilising the facility will afford the attendant such co-operation or information as necessary in order that they can ensure the requirements of the Site Licence are not infringed. |
|
7. |
No person shall sort over or remove any material from the sites except by prior written agreement of the Director. In addition no person shall loiter at or near the site with a view to carrying out such activities. |
|
8. |
Special or Clinical wastes are not permitted on site and all such instances of wastes arriving at the site will be recorded and reported to SEPA. |
|
9. |
All persons using the site shall take advice from the attendant to ensure that recyclable fractions where possible are placed in the proper bank or container. |
|
10. |
Any inspector or recycling agent visiting the site shall be requested to record the visit in the Site Diary. |
|
11. |
All users of the sites shall have regard to speed restrictions in operation at the facilities. |
|
12. |
No Dogs, except guide dogs and hearing dogs, will be permitted at the sites. |
|
13. |
No person shall start, or attempt to start, fires of any nature on site. |
SUPPLEMENTARY MANAGEMENT RULES FOR LANDFILL SITES
North Lanarkshire Council (hereinafter referred to as 'the Council') by virtue of the powers conferred on them by Section 112 of the Civic Government (Scotland) Act 1982 hereby make the following Supplementary Management Rules to regulate the use of and conduct of persons while in North Lanarkshire Council's Landfill Sites. These Supplementary Management Rules should be read in conjunction with the Management Rules for the Department of Community Services.

All vehicles entering the Landfill Site must be registered by the Council. Vehicles not registered shall be refused entry to the Landfill Site. |
|
2. |
All wastes entering the Site require to be inspected and accurately recorded on the weighbridge to ensure that the wastes for disposal are permitted in terms of the Site Licence and are in accordance with the description given in the consignment note in terms of the "Duty of Care" Regulations. A three part Weighbridge ticket must be produced for the load and duly signed by both the driver and the Weighbridge attendant before being allowed on Site for deposit. |

Any carrier of waste to the Site requires to ensure that he has the appropriate documentation and that the loads are properly secure. |
|
4. |
Wastes, which are not permitted, shall be refused entry to the Site and directed to a suitably licensed disposal facility. |
|
5. |
Visitors to the Site, not depositing wastes, are required to record the date, name, name of their organisation/company and purpose of the visit in the Visitor's Book provided in the Office. |
|
6. |
All drivers must follow the directional signs to either the tip face, isolation or hot load areas as instructed by the Site Supervisor or Weighbridge Attendant. |
|
7. |
All drivers must obey the speed restrictions within the site. Speed ramps are installed on Site. |
|
8. |
All drivers must exercise due control and await instructions from either the banksman or the machine driver at the working face. |
|
9. |
All drivers must wear high visibility jackets and protective footwear at the operational working face. |
|
10. |
Vehicle passengers must not alight from their vehicle at the discharge area. |
|
11. |
All tipping vehicles must have their bodies/bins/skips lowered before moving from the operational area. It is the driver's responsibility to ensure that his vehicle/body/skip/bin is free of waste before leaving the tip face. Waste may only be deposited at that day's nominated tipping area. |
|
12. |
The sorting or removal of waste from within the confines of the Landfill Site is expressly forbidden without the approval of the Director. |
|
13. |
Where towing is required on the Landfill Site, drivers will be responsible for attaching tow chains to their own vehicles. |
|
14. |
Any damage to vehicles or injury to personnel must be informed to a member of Site staff immediately. |
|
15. |
All vehicles leaving the Site must correctly use the wheelwash. |
|
16. |
Smoking is not allowed at any time within the boundary of the Landfill Site except in the Site Canteen. |
|
17. |
No person shall light a fire, burn or do any action which might cause to be set on fire or burned in the Landfill Site any paper, rubbish, refuse, fuel or other substance. |
SUPPLEMENTARY MANAGEMENT RULES FOR CLEANSING DEPOTS
North Lanarkshire Council (hereinafter referred to as 'the Council') by virtue of the powers conferred on them by Section 112 of the Civic Government (Scotland) Act 1982 hereby make the following Supplementary Management Rules to regulate the use of and conduct of persons while in North Lanarkshire Council's Cleansing Depots. These Supplementary Management Rules should be read in conjunction with the Management Rules for the Department of Community Services.

All vehicles must abide by the speed limit. |

All visitors cars must be parked in the car park provided. |
|
3. |
All visitors must report to reception. |
|
4. |
No visitors are permitted to move about the depot unaccompanied. |
|
5. |
Any accidents must be reported to the management immediately and the relevant paperwork completed. |
|
6. |
Visitors must not approach any vehicles or machinery within the depot. |
|
7. |
Visitors must not walk behind reversing vehicles. |
|
8. |
Visitors must abide by instructions issued by management. |
|
9. |
Visitors are not permitted in shower rooms, canteen area or garage area without permission. |
